The Texas Criminal Pattern Jury Charges—Crimes against Persons and Property special supplement, affecting CPJC 91.8 (Lesser Included Offense Analysis and Relationship between Trespass and Burglary) and CPJC 91.10 (Terminology: “Of Another” and “Ownership”), clarifies certain aspects of the crimes of burglary and criminal trespassing. CPJC 91.8 has been supplemented with updated case law, in particular State v. Meru, 414 S.W.3d 159, 163–64 (Tex. Crim. App. 2013), that addresses the different requirements of proof of entry for burglary and for criminal trespassing. Revisions to CPJC 91.10 provide additional detail about the proof requirements of ownership and greater rights to possession in burglary and criminal trespassing trials.
